IN MOTION j.d.o.o. Travel Agency, Passenger Travel Management provides travel services, coordinating 3 fleets for different types of high-end transportation: Mercedes-Benz Fleet, Aircraft and Helicopter Fleet, and Yacht Charters.  

Service provided by IN MOTION j.d.o.o. Travel Agency, Passenger Travel Management available for booking on web site www.inmotion.hr is economy touristic transfer. 

Other travel services (VIP transfer, customized private tour, private jet charter, helicopter transfer, yacht charter) provided by IN MOTION j.d.o.o. Travel Agency, Passenger Travel Management are available on inquiry.

The services we provide are only available for personal, non-commercial use. It is therefore not permitted to resell, distribute through a deep link, use, copy, track (e.g., via spider, scrape), display, download or/and reproduce any content or information, software, products or services available on our website, for any commercial or a competitive activity or purpose. 

Before booking and/or inquiring the services offered on our www.inmotion.hr website, you should read and understand these Terms and Conditions as they will govern each subsequent contract. By booking, you confirm that you have read these Terms and Conditions and that you are legally capable of accepting them on your own behalf and for all Travelers. If you do not understand any of the terms of the Agreement, we recommend that you contact travel agent on e-mail address info@inmotion.hr before proceeding with your booking. If you do not wish to be bound by these Terms and Conditions, unfortunately you cannot book our services.

By completing the booking form or/and inquiry form, you confirm that you are able to enter into legally binding contracts in your own name and on behalf of the passenger. The booking form or/and inquiry form will be considered an integral part of these Terms and Conditions. 

If for any reason you refuse to accept these Terms and Conditions, unfortunately you may not book the services. IN MOTION j.d.o.o. Travel Agency, Passenger Travel Management will not provide you with services for which you have not agreed to these Terms and Conditions. 

Nature and scope of the touristic transfer service

The touristic transfer service is the rental of a private vehicle with a driver who is providing travel and handling assistance. It is impossible to guarantee the exact transfer route. The maps on our website are illustrations in this regard. While we will take all reasonable steps to adhere to arrival and departure times in accordance with the booking form and information provided on our website, all stated dates and durations are non-binding estimates. 

In case of difficulties encountering the chauffeur, call our travel agent 00385(0)95 314 0239. If you do not do so but order an alternative transport service, we will be deemed to be completely relieved of any contractual, actual or legal obligation or liability to you. This includes your possible refund requests. If you are not at the place and at the time of the scheduled start of the service, nor do you arrive at that place within the next 15 minutes (30 minutes if the starting point is the airport), nor do you contact our agent by phone, e-mail or do not answer any of the 2 (two) phone calls from our travel agent or chauffeur to the number you stated when booking, we will consider that you have not appeared (no-show) and charge you fully for all services you have ordered. In accordance with established business practice, digital records from our servers will be considered as proof of the time of telephone calls. 

The vehicles shown on the booking form page are illustrative in nature. We have the right to assign a larger vehicle, or similar vehicle, or several vehicles of the same value to your transfer without prior notice. 

You are responsible for checking the agreed pick-up time and ensuring arrival at the airport, station or port or any agreed location with sufficient time for check-in or other travel arrangements. The chauffeur will pick you up and leave you as close as possible to the given addresses. In case the access to the usual route is closed due to weather conditions, traffic accidents, special events, works etc., the chauffeur will, at your express request, use a longer route to reach the agreed destination, but in such cases, you will be responsible for any additional costs incurred if they occur. All contracted services fall within the scope of public liability coverage of the company’s Insurance Policy or the insurance of their subcontractor. 

Information regarding travel package

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights applying to packages.

Company IN MOTION j.d.o.o. insured with GENERALI GROUP d.d. will be fully responsible for the proper performance of the package as a whole. Additionally, as required by law, company IN MOTION j.d.o.o. and GENERALI GROUP d.d. have protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes/they become insolvent.

Key rights under Directive (EU) 2015/2302:
— Travellers will receive all essential information about the package before concluding the package travel contract.
— There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
— Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organizer or the travel agent.
— Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
— The price of the package may only be increased if specific costs rise (for instance fuel prices), and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organizer reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
— Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
— Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
— Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
— If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organizer fails to remedy the problem.
— Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
— The organizer has to provide assistance if the traveller is in difficulty.
— If the organizer or, in some Member States, the retailer becomes insolvent, payments will be refunded. If the organizer or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured.

IN MOTION j.d.o.o. has taken out insolvency protection with GENERALI GROUP d.d. Travellers may contact this entity (GENERALI GROUP d.d., Slavonska avenija 1b, 10 000 Zagreb, Croatia; info.hr@generali.com, 00385 (0) 1 4600 400) or, where applicable, the competent authority if services are denied because of IN MOTION j.d.o.o.’s insolvency.

Travel Agency, Passenger Travel Management or/and our contractual partners is regulated by licences in our possession and protected by state legislation, as well as international provisions relating to intellectual property rights.
We prohibit you from using or exploiting our websites or any part of their content for any purpose other than ordering our services. This includes any commercial or competitive purpose as well as the full or partial duplication of our content by any means, which in particular includes practices known under the English names of scraping and deep linking accomplished in any way, without our prior written consent. Our websites are protected, as well as their entire content, by business and intellectual property rights, and are the exclusive property of IN MOTION j.d.o.o.
